Marbella breathes a sigh of relief & celebrates major milestone: New PGOM finally set for approval


The City of Marbella, one of Spain’s most popular coastal destinations is about to adopt its new long-awaited city code. Plan General de Ordenación Municipal (PGOM)The updated general urban planning plan for the city. The local council will likely grant approval to the plan in the next few weeks, following a favorable report from the Junta.

The PGOM is replacing the PGOU, which was outdated in 1986 and governed planning for urban development for over four decades. This new framework is in accordance with Andalucia’s regional laws. As a result, the city has become the first in Andalucia which has successfully adapted. This plan provides a comprehensive map for land classification, sustainable development, infrastructure, green space, and connected developments. This plan will help build new homes urgently and create more jobs in Costa del Sol.

Marbella old judgment annulled

This long delay is the result of a turbulent past in urban planning. In 2015, the Supreme Court of Spain annulled a 2010 revision after irregularities in the 1990s during previous administrations. This forced a return to the rules from 1986. This prolonged the regulatory limbo and caused thousands of projects to be halted, complicated property classifications and legal uncertainty among owners and developers due to changing environmental standards and population growth.

The new PGOM offers greater legal certainty to property owners and promises reduced bureaucracy. It also promises faster permit processing.

Good news for expat developers

Marbella’s expat community, which makes up around one third of its residents, is delighted by this. The clearer rules will increase confidence among international investors and buyers, as well as reduce risks in the property market. This unlocks potential for development, encourages controlled expansion of facilities, and maintains the high standard of living that attracts retirees, families and high-net-worth individuals.
