That breezy pose can cost you: Spain’s DGT can fine drivers €80–€200 if an arm out the window reduces control or attention—even on a scenic summer drive.

Bad driving habits increase when the temperatures rise: windows down and flip-flops are worn. The Spanish DGT does not fine for the attire or posture, but rather the attitude. You can also find out more about us on our website. You will be fined if you lose control of your vehicle. That’s why the classic “codo en la ventanilla” can end in a ticket of €80 to €200.
Is it illegal to drive with your elbow outside?
Not automatically. It’s fine to crack the window for airflow. Resting your arm outside of the cabin is not a problem, but it does mean you are no longer in control. Spanish officers apply the Reglamento General de Circulación (RGC) — and three articles matter here:
- Article 18.1 – the driver must maintain freedom of movement, a clear field of vision and constant attention, and keep an appropriate driving position.
- Article 17.1 – drivers must be able to control their vehicles at all times.
- Article 3.1 – driving must be done with the necessary diligence and caution to avoid harm.
An officer can use one or more provisions if they believe your elbows-out stance compromises balance, vision, or attention. It’s not the pose—it’s its effect on control.
What is the amount of a fine when it occurs?
Case-by-case penalties are applied. The fine will depend on whether the posture was judged to restrict movement, reduce steering accuracy or distract.
- €80 for lesser breaches (light infringement).
- Up to €200 where the risk is deemed higher (serious infringement).
Remember: if a manoeuvre or incident exposes greater danger — say, you swerve while your arm is outside — the sanction can escalate. In Spain, the officers’ assessment on-the-spot is always taken into consideration.
DGT checks summer attire at the wheel
No dress code is specified in the rules. Flip-flops and swimwear are not fined. If your footwear falls off the pedal or you are unable to brace yourself properly when making an evasive maneuver, then you will be subjected to the same RGC articles about position, control, and diligence. The result can be the same €80–€200 ticket.
Spain driving tips: DGT advice to avoid the €200 ‘arm-out-the-window’ fine
- You should keep both hands free, and assume a position where you can steer and respond instantly.
- Select footwear that is secure and won’t slip or snag.
- If you’re hot, use ventilation or air-con — not the window as an armrest.
- Consider yourself an examiner. Can you execute a perfect emergency stop or sudden turn from your current position. If not, make adjustments.
It’s fine to roll the window down, but it isn’t okay if you lose control. This summer, enjoy the breeze — with both hands ready on the wheel — and keep those €80–€200 in your pocket.
