A JUDGE has refused to deport an individual to Singapore who was accused of killing Audrey Fang and would have been subject to the death sentence if found guilty.
Mitchell Ong (44), who was living in Spain illegally when Fang died in April 2024, had been asked to leave by the Policia Nacional.
Ong failed to meet the criteria laid out by Spanish laws regarding the expulsion or foreigners. A court in Cieza in Murcia found this.

One of these states that an immediate deportation may occur if a person has been charged with an offense, and a prison sentence is less than six-years, or an alternative sentence is imposed, such as an fine.
Ong, who is facing a potential murder charge, has a minimum 15-year jail term. He does not meet the criteria for being expelled.
Maria Jesus Ruiz de Castaneda was Ong’s attorney and she had resisted the request back in May.
She claimed that the expulsion of Spain would violate the rule of law, as well as international treaties signed and ratified by Spain.
She said, “He’s involved in ongoing criminal cases in Spain where he has to be tried according to due process.”
She added that “expulsion would be in violation of the European Convention on Human Rights and the principle against death penalty, as well as Spain’s commitments to non-refoulement.”
Ong’s lawyer had previously demanded that all charges be dismissed, stating that all the necessary evidence had to be examined and that Ong ‘firmly and consistently’ insisted he did not kill Audrey Fang.
Currently, he is being held in Sangonera prison (Murcia).
He was accused of murdering Audrey Fang in April 2024 while she was vacationing in Spain. She stayed at the Javea hotel, on the Costa Blanca.
Ong was seen in the CCTV footage picking her up at the hotel.
Her body was found on 10 April dumped in a lorry parking in Abanilla, Murcia – about 150 km away.
Audrey was stabbed 30+ times. Ong was arrested 6 days later, in Alicante.
They were said to have had an ‘on-off’ relationship for over a decade.
