GOURMANDS could be forgiven for thinking they saw double in Marbella.
It is true that there are two restaurants in the same name La Petite Maison.
The favourite Côte d’Azur eaterie of Elton John, Bono and Madonna opened two new sister joints on the Costa del Sol around the same time.

One was spotted in the grounds at the Golden Mile hotel Boho Club while the other appeared at the five-star luxury rival Puente Romao.
The problem is… only one of them is legal.
Nicole Rubi has retained the name of the restaurant after a two-year battle with the Audiencia Provincial Court in Madrid. She proved that the trademark was hers.
Her famous Nice Restaurant opened in 1987, and has long been a favorite of the rich.
It became the favorite bistro of foodies who know what they are doing thanks to its simple menu with Provencal influences and charm.

“We signed the agreement in 2023 but had to delay opening until the outcome the court case.”
A court ruling dated September 25, 2009, awarded the Rubi family trademark in Spain.

The Rubi family gave the rights of the Rubi restaurant to Arjun Wany, who is a UK restaurateur.
Azur Limited has been granted the right to open any restaurant in the entire world by his company until 2022.
It didn’t have any offices in Spain but, nine months before the expiration date, it transferred its international registration to a Dubai-based company.
The Rubi family claimed that this was a bid to gain control of the Rubi brand after the license ended, and the Spanish Patent Office agreed.
The Madrid Court has now blocked the court’s decision, which annulled the trademark.
The Rubi family is now able to pursue their own agreement, with Puente Romano. And the court has ordered that Azur’s Dubai holding will pay their legal fees.
Shamoon continued, “We are thrilled with the outcome and we will open in spring.”
A spokeswoman from the Boho Club’s holding company, claimed that the trademark proceedings have ‘not reached final conclusion yet’.
She added the hotel had ‘valid registered trademarks’.
She stated that the decision was appealed and trademarks were still active in our company. The proceedings are not yet at a conclusion.
