Butibamba assault – man detained. Man could face 3 years

The local police of Mijas arrested an accused man in the early hours on September 4, 2025. He was accused of assaulting his partner in La Cala de Mijas near La Butibamba Park. Police responded quickly to an emergency call made to 112 to report the incident.

Upon arrival, the officers separated each individual and conducted separate interviews. Eyewitnesses reported that the woman had bruises on both her arms and legs, consistent with a physical assault. The incident was corroborated by multiple witnesses who said they witnessed the man hitting his partner.

The suspect was immediately arrested, informed of his legal rights and taken to the Guardia Civil station where he will be prosecuted. In Spain, under the Organic Law 1/2004, Comprehensive protection measures against gender based violence, acts of violence against women are treated as serious crimes, with penalties that can reach up to three years in prison for minor injuries and longer for more aggravated ones.

The victim received medical help and was given the chance to file a formal grievance against her attacker. Authorities haven’t released any more details about the victim or the ongoing investigation.

This incident is a good reminder that Spain has a strong legal framework to address gender-based violence. It includes Gender Violence Courts, and immediate protection measures such as restraining Orders. The severity of cases such as these is not known to many tourists who arrive in Spain. If the accused is found to have intended to harm his partner, he will likely be sentenced to at least 3 years of prison.

The local police of Mijas reported that the case was still being investigated and the suspect was awaiting court proceedings. Given the timeframe involved, however, it is likely that the sentence had already been given.
