Online advertising is banned for thousands of owners of tourist apartments


A new European regulation will come into force on Tuesday, July 1. It requires owners of short-term rentals, such as holiday or seasonal accommodation, Airbnb, and similar properties, to register at the Single Rental Registry to be able to advertise their property digitally.

The National Institute for Statistics, Spain’s national statistics agency, has approved this registry in January. It assigns a unique number to all advertisements in order to increase control and transparency.

What are the penalties for owners who fail to register their vehicles?
Owners who fail to register their rental properties properly in the Single Rental Registry, or do not correct inaccurate information following the receipt of a provisional code after receiving it, may be removed from the market. Digital platforms must remove listings that are not compliant within 48 hours of notification. Additionally, owners may face fines ranging from €2,000 to €500,000, depending on the autonomous community and the severity of the violation.

Booking has removed more than 4,000 listings due to similar criteria. The Madrid High Court of Justice also supported this mass removal.

Andalucía tops registration applications with 49,397 requests for the new mandatory register to continue online advertising. 24405 of these have been granted provisional approval and 4,920 had their permission revoked. Only a third remain from the 147,000 properties that are listed on Turismo. This means over 70% will be removed under the new law.

The Digital Single Site for Rentals is a new tool that facilitates the registration of tourist accommodations. These are the ones who verify that the property can be rented.

In order to complete the application, you must provide information about the property such as its address, cadastral code, type of use and maximum capacity as well as relevant regulations and the location. Owners also need to provide personal information such as their name, NIE/DNI, tax address and contact details.
