How to comply with Spain’s new rental regulations for tourists? CSN News

All owners of a property for tourist rental have until 1 July to register it in Spain’s Registro Único for holiday rentals. Anyone who wants to advertise their house or flat on holiday platforms as well as anyone who would like to rent it out for a short term is required to take this step. This procedure is necessary even if the property owner has already registered the property in the Andalusian Tourism Register.

This regulation acts as a conduit for electronic data transmission between online platforms that offer short-term rentals and the authorities. It aims to educate people about the different uses, rules and destinations of short-term accommodation.

Regulations cover tourist rentals as well as seasonal rentals, rentals of rooms or other properties which provide short-term lodging for financial gain. According to the Ministry of Housing, “the target scope encompasses both the services that online platform providers provide to short-term accommodations hosts in Spain as well as the rental services provided”.

Owners must obtain a registration code, provide all the information required, respond to any requests for information and update it whenever there are changes. They also need to notify the online platforms with the registration code assigned by land registry or register of real estate. The online platforms must ensure that the landlords use this number to identify their property in their applications. The decree entered into force on the 2nd of January and had a deadline set for 1st July.

How can owners comply to this rule? 

According to the regulation, the application for an registration number can be made through the electronic headquarters or the land registry or real estate register.

The land registry will assign an automatic registration number once the documents have been submitted. The registration number is recorded once the required requirements are met. The interested party is notified. If the documentation is incorrect and the interested person does not rectify it within seven days, then the validity of registration number will be suspended. The general directorate of planning and evaluation of Ministry of Housing will inform all short-term online rental platforms to remove or disable the access. This number will need to be entered into the various online rental platforms that advertise the accommodation.

What documents must be submitted? 

Documentation required to get the holiday rental registration is the tourist license, the habitation certification, the cadastral number and the exact address. In addition, it is necessary to specify whether you plan to rent your property in its entirety or by room. It is also important to state the maximum number people that can be accommodated and confirm that the property meets all of the requirements for the area where it is located.

What are the steps to be taken? 

The first step is to access the Sede Electrónica de los Registradores de España by clicking on the button at the end of the instructions. You will then need to proceed to authentication. To do this, you’ll need to provide a digital ID or certificate to verify your identity. You will then be able to complete the registration form with the required details for the property. After the information is validated, an NRA (rental registration number) will be issued to the owner. This is necessary for the marketing of your property through tourist platforms. Registration costs 27 euros plus any taxes or deductions.

 How long does the registration last?

A model of short-term rentals must be presented every 12 months for each type and category of lease. The property cannot be advertised via digital platforms (OTAs) if it is not registered. This will result in financial penalties and the suspension of the rental as a holiday property.
